외교통산부는 한·미 쇠고기 추가 협상시 한·미 양국이 합의한 문서를 25일 공개했다.

특히 미 정부의 서한은 서명본 접수 즉시 공개 예정임을 지난 21일 추가 협상 결과 발표시 밝혔으나, 동 서한의 조기 공개 요청이 있음에 따라 우선 서명되지 않은 서한을 공개한다.
동 서한의 서명본은 우리 고시의 발효와 동시에 미측이 우리측에 전달해올 예정이며, 동 서명본도 접수 즉시 공개할 예정이다.

수입위생조건 추가 고시 부칙
부칙 2항의 규정에도 불구하고, 민간부문의 경과조치를 지원하기 위하여, 우리 소비자들의 미국산 쇠고기에 대한 신뢰가 회복될 때까지 미 농업부의 “30개월 미만 연령 검증 품질체계평가(QSA) 프로그램”에 따라 검증된 작업장에서 생산된 쇠고기 및 쇠고기 제품만 반입이 허용된다. 이 경과조치 기간동안 30개월 이상 소에서 생산된 쇠고기가 발견될 경우, 해당 쇠고기 및 쇠고기 제품을 반송한다.
30개월 미만 소의 뇌, 눈, 머리뼈, 또는 척수는 특정위험물질 혹은 식품안전 위해에 해당되지 않는다. 그러나 수입자가 이들 제품을 주문하지 않는 한, 이들 제품이 검역검사과정에서 발견될 경우, 해당 상자를 반송한다.
본 수입위생조건 제8조의 해석과 관련하여, 대표성 있는 표본에 대한 현지점검시 한국정부는 점검이 필요하다고 판단하는 특정 작업장을 점검 대상에 포함시킬 수 있다. 현지점검 결과 점검단이 본 수입위생조건에 대한 중대한 위반사항이라고 판단되는 것을 발견할 경우 점검단은 적절한 개선조치에 대해 즉시 미국 정부 관계관과 협의한다. 이 기술적인 협의로 문제를 해결하지 못할 경우, 양국정부는 고위급 협의를 한다.
양국 정부가 4주 이내에 적절한 개선조치에 대해 합의하지 못할 경우, 한국정부는 비록 해당 작업장의 제품에 대한 수입 검역검사과정에서 식품안전위해가 발견되지 않았다고 하더라도 해당 작업장에서 이후 수입되는 다섯 번의 선적분에 대하여 쇠고기 및 쇠고기 제품의 검사비율을 높일 수 있다. 본 수입위생조건 제24조의 해석과 관련하여 상기 강화된 검사기간 동안 또는 일반적인 검사에서, 2회 이상 식품안전 위해가 발견되면, 한국정부는 미국정부에 해당 작업장의 중단을 요청할 수 있다. 이 요청을 받는 대로 미국정부는 해당 작업장을 중단시켜야 한다. 한국정부는 차기 시스템 점검시 해당 작업장을 재점검할 수 있다.
Addendum
7. Notwithstanding Addendum 2, in order to support a transitional private sector initiative, beef and beef products produced only by establishments participating in the USDA Less than 30 Month Age-Verification Quality System Assessment (QSA) Program will be allowed to enter Korea, until Korean consumer confidence in U.S. beef improves. During this transition period, if the Korean government finds that any beef from cattle of 30 months of age and over has been shipped to Korea, the relevant beef or beef products will be returned to its owner.
8. Brain, eyes, skull, or spinal cord from cattle less than 30 months of age are not SRMs or food-safety hazards. Nevertheless, as long as Korean importers do not place orders for these products, if these items are detected during the quarantine inspection process in Korea, the Korean government may return the relevant box or boxes to its owner.
9. For greater certainty, in interpreting Article 8, on-site audits of a "representative sample" do not prevent the Korean government from including in an audit a specific plant that it deems necessary to audit. If as a result of an audit, Korean auditors find what they believe is a serious non-compliance with these Requirements, the Korean auditors will immediately consult with FSIS personnel regarding appropriate corrective action. If these technical level discussions do not resolve the matter, the two governments will consult at a senior level. If the two governments cannot agree with respect to appropriate corrective action within four weeks, Korea may increase the rate of inspection of subsequent beef and beef products from that establishment over the next five shipments notwithstanding the fact that no food-safety hazards have been detected during import quarantine inspection of the products of that establishment. For greater certainty, in interpreting Article 24, if two or more food safety hazards are detected, during this period of increased inspection or generally, Korea may request FSIS to suspend the relevant establishment. Upon receiving the request, FSIS shall suspend the establishment. Korea may also re-audit that facility in its next system audit.

한국을 위한 30개월 미만 연령 검증 품질체계평가(QSA) 프로그램
미 농업부는 수입위생조건 고시가 게재되는 대로 한국 수입자를 위하여 새로운 품질체계평가(QSA) 프로그램을 도입할 것이다.
이 프로그램의 명칭은 “한국을 위한 30개월 미만 연령 검증 품질체계평가(QSA) 프로그램”이 될 것이다. 이 프로그램은 자격 있는 작업장에서 생산된 제품이 30개월 미만 소에서 생산되었음을 보증하는데 가장 효과적인 방법이다.
QSA 프로그램은 1946년 농산물유통법(7 U.S.C. 1621 et seq.)에 따라 승인된 미국 정부가 관리하는 프로그램이며, 연방규정집(7 C.F.R. Part 62) 뿐만 아니라 미 농업부 농업유통국(AMS)의 감사·검토 및 준수부서(ARC) 1000 절차 품질체계 검증 프로그램의 일반 정책과 절차, ARC 1002 절차 품질체계 평가 프로그램, #GU7309CCA 지침과 QSA/PVP 생동물 생산기록요건에 규정되어 있다. QSA는 ISO 9001:2000 품질관리 시스템 기준에 기초한다.
AMS는 한국을 위한 30개월 미만 연령 검증 품질체계평가(QSA) 프로그램에 참가하는 자만이 동 프로그램에 따라 30개월 미만 소에서 생산된 쇠고기를 수출한다는 것을 확인할 것이다. 이는 개별 참여 회사가 정기적으로 점검받을 예정인 품질관리 시스템을 수립, 기록, 이행 그리고 유지하도록 요구함으로써 달성된다. QSA 프로그램은 미국 수출작업장의 책임 있는 직원이 본 프로그램을 이행하도록 훈련받을 것을 특별히 요구할 것이다.
한국 수입자와 검사당국은 제품을 선적한 작업장이 미 농업부 웹사이트에 한국을 위한 30개월 미만 연령 검증 품질체계평가(QSA) 프로그램에 따라 승인된 곳으로 등재되어 있음을 확인함으로써 제품의 적합여부를 검증할 수 있다.

Dear Minister Kim and Minister Chung:
In light of the ongoing public discussion in Korea, we welcome the voluntary commitments made by Korean importers and U.S. exporters to trade only U.S. beef from cattle less than 30 months of age. This private-sector initiative will serve as a transitional measure until Korean consumer confidence in U.S. beef improves.
To support these voluntary commitments, the U.S. Department of Agriculture is establishing the "Less than 30 Month Age-Verification Quality System Assessment (QSA) Program for Korea" administered by the U.S. government under the Agricultural Marketing Act. This program will be operationally identical to the quality system requirements in place for all USDA Export Verification (EV) Programs. (See attachment.) This program will verify that all beef shipped to Korea under this program is from cattle less than 30 months of age.
We understand that in order to support this private sector initiative, if Korean government inspection officials were to find any beef shipped to Korea during the transition period that is from cattle 30 months of age or over, they would return the relevant beef or beef products to their owner.
The governments of the United States and Korea agree that brains, eyes, skull, and spinal cord from cattle less than 30 months of age are not specified risk materials under World Organization for Animal Health (OIE) guidelines or food-safety hazards. Importers and exporters in our two countries have nonetheless indicated that those items have not been traded in the past, and, until there is market demand in Korea for such products, our expectation is that such commercial practice will continue.
When auditing a representative sample of the meat establishments that export beef or beef products to Korea, as provided for in Article 8 of the Import Health Requirements, Korea’s auditors have the right to focus on certain plants, such as those that are newly listed, had been previously delisted, or whose products have raised concerns during port of entry inspection. Accordingly, the concept of representative sampling does not prevent Korean officials from including in an audit a specific plant that they deem necessary to audit.
If as a result of an audit, Korean auditors find what they believe is a serious non-compliance with these Requirements, the Korean auditors will immediately consult with FSIS personnel regarding appropriate corrective action. If these technical level discussions do not resolve the matter, the two governments will consult at a senior level. If the two governments cannot agree with respect to appropriate corrective action within four weeks, Korea may increase the rate of inspection of subsequent beef and beef products from that establishment over the next five shipments notwithstanding the fact that no food-safety hazards have been detected during import quarantine inspection of the products of that establishment. As was recently reconfirmed by Korean beef importers, U.S. beef is safe, and it is consumed by Americans every day. We look forward to the rebuilding of Korean consumer confidence in the safety and quality of U.S. beef.

Less Than 30 Month Age Verification QSA Program for Korea
USDA will establish for Korean importers a new Quality System Assessment (QSA) Program upon publication of the notification of import requirements. This program will be called the "Less Than 30 Month Age Verification QSA Program for Korea".This is the most effective way to verify that product from eligible plants will be derived from cattle less than 30 months of age.
QSA Programs are U.S. Government-administered programs authorized under the Agricultural Marketing Act of 1946 (7 U.S.C. 1621 et seq.) and are defined in the Code of Federal Regulations (7 C.F.R. Part 62) as well as USDA, Agricultural Marketing Service (AMS) Audit, Review and Compliance Branch (ARC) 1000 Procedure Quality Systems Verification Program General Policies and Procedures, ARC 1002 Procedure Quality Systems Assessment Program and Guidance #GU7309CCA and QSA/PVP Live Animal Production Record Requirements. QSAs are based on the ISO 9001:2000 Quality Management System standards.
AMS will ensure that participants in the Less Than 30 Month Age Verification QSA Program for Korea only export beef produced under the program that is sourced from cattle less than 30 months of age. This is accomplished by requiring each participating firm to establish, document, implement, and maintain a quality management system that will be audited on a regular basis. The QSA Program will specifically require that responsible U.S. exporter plant personnel be trained to implement this program.
Korean importers and inspection authorities will be able to verify product conformance by ensuring the establishment shipping the product is listed on the USDA website as being approved under the Less Than 30 Month Age Verification QSA Program for Korea. For U.S. exporters who participate in this program, it will be operationally identical to the quality system requirements in place for all USDA Export Verification (EV) Programs. As countries come into compliance with OIE internationally recognized standards, USDA is phasing out EV Programs in favor of the underlying QSA Programs. U.S. beef from participating plants will be accompanied by FSIS 9060-5 Export Certificate of Wholesomeness with a statement in the "remarks section" stating that the beef or beef products were produced at a verified establishment under the USDA "Less Than 30 Month Age Verification QSA Program for Korea."

품질체계평가(QSA)

뇌, 눈, 머리뼈 및 척수
30개월 미만 소의 뇌, 눈, 머리뼈 및 척수는 특정위험물질 또는 식품안전 위해에 해당되지 않으나, 한국 수입자가 특별히 요청하기 전까지는 뇌, 눈, 머리뼈 및 척수는 수입되지 않을 것이다. 정상적인 표본 검사과정에서 이런 제품이 확인되는 경우, 해당 상자(들)는 소유주에게 반송될 것이다.
머리뼈의 뼈조각(bone chips) 또는 척수의 잔여 조직과 같은, 30개월 미만 소의 머리뼈 및/또는 척수의 잔류물질 때문에 해당 상자(들)가 불합격되지 않을 것이다.
표본추출
미국에서 수입되는 쇠고기 및 쇠고기 제품은 무작위 표본추출에 근거하여 검사될 것이다 (수입축산물 관리 기본 지침에 따라 1-3%)
이물질
정상, 무작위, 표본추출에 근거한 검사 시스템의 일환으로 이물질이 확인될 경우 차후 해당 생산 작업장에서 생산된 로트중 표본추출된 수량이 엑스레이 검사를 받을 것이다.
미국내 한국 수의관 배치
미국에 배치된 한국 수의관은 동물위생 및 식품안전 문제에 관한 정보 수집과 미국 정부 기관과의 협조를 포함하여 동물위생 및 식품안전 분야에서 역할을 수행할 것이다.
이들은 한국 점검단의 일원으로서 수입위생조건 제8조에 규정되어 있는 현장점검을 지원하거나 실시할 수 있다.
혀 및 내장 조직 검사
한국과 미국은 혀 및 내장에 대한 현미경 검사를 실시하기 전에 특정위험 물질을 검출함에 있어 이러한 검사의 실효성을 정당화하기 위한 과학적 근거를 검토하기 위해 기술 협의를 가질 것이다.

9060-5 Statement Language:
The beef or beef products were produced at a verified establishment under the USDA "Less than 30 Month Age-Verification Quality System Assessment (QSA) Program for Korea."
Guidance Footnote for T-Bones and Porterhouse steaks:
*This requirement will be in place for 180 days following the effective date of the import health requirements. The Korean government and the U.S. government agree to have consultations upon the completion of the 180 day period with a view to addressing concerns after reviewing the notation’s effect on beef trade and its inspection.
QSA:
During the transitional period, any product accompanied by FSIS 9060-5 Export Certificate of Wholesomeness with a statement in the remarks section stating that "the beef or beef products were produced at a verified establishment under the USDA "Less than 30 Month Age- Verification Quality System Assessment (QSA) Program for Korea" will undergo normal import quarantine inspection.
If the exported product is not accompanied by the statement referenced above, the affected lot will be returned to the owner.
Brain, Eyes, Skull and Spinal Cord
Until specifically requested by a Korean importer, brain, eyes, skull, and spinal cord will not be imported even though these products from cattle less than 30 months of age are not SRMs or food-safety hazards. If these products are identified during normal, sample-based inspection procedures, the relevant box or boxes may be returned to its owner.
Any remnants of the skull and/or spinal cord form animals less than 30 months of age, such as bone chips from the skull or residual tissues from the spinal cord will not result in rejection of the box or boxes.
Sampling:
Beef and beef products imported from the United States will be inspected on a random sample basis (1-3% as outlined in the Basic Guidelines for Management of Imported Livestock Product).
Foreign Material:
If foreign material is identified as part of the normal, random, sample based inspection system, a sample number of subsequent lots from the producing establishment will be x-rayed.
Posting of Korean Veterinarian Officer(s) In the United States:
Veterinary officers posted in the United States will perform functions in the fields of animal health and food safety, including gathering information and working with U.S. government agencies on animal health and food safety issues.
As a member(s) of the Korean auditing team, they may facilitate and conduct on-site audits as provided for in Article 8 of the protocol.
Tissue examination of tongues and intestines:
Prior to conducting microscopic examination of tongues and intestines, Korea and the United States will hold technical consultations to review the scientific background justifying the validity of this examination in detecting SRMs.
